The special thing about OÙVENIR is: if you’ve found a product that you’d like to take home, you can buy it immediately from the supplying store! You have three options in this case:
a) Order and have your products delivered to your hotel on the same day
b) Order and have your products delivered to your home address
c) Reserve your products and pick them up in person from the store

The OÙVENIR payment process is very simple and payments are made via our secure partner, stripe, which operates internationally. The advantage for you: you can pay for all your products with one single payment, even if they come from different stores. We accept all valid methods of payment. After making a successful payment, you will receive an email to confirm whether the item is available in store and if they accepted the order, as well as all the delivery details.
We work exclusively with local stores and manufacturers which each have their own opening hours. For this reason you will generally receive your confirmation email within these opening hours.

Bitte beachten Sie bei Importen aus Europa, dass der Zoll eventuell eine IRS, EIN oder SS-Nummer von Ihnen verlangt, bevor Ihnen Ihre Ware zugestellt wird. Sie haben dann eine Woche Zeit, dem Zoll diese Nummer mitzuteilen. Hier erfahren Sie mehr zu den US-amerikanischen Zollbestimmungen.
VERSAND NACH RUSSLAND
Zu beachten: Lieferungen nach Russland benötigen drei bis vier Tage.
Solange Ihre Bestellung den monatlichen Import-Freibetrag von 1000€ nicht übersteigt und/oder nicht mehr als 31kg wiegt, fällt für Ihre Bestellung keine Zollgebühr an. Beispiel 1: Am 5. Oktober haben Sie eine Lieferung im Wert von 100€ erhalten und am 20. Oktober eine im Wert von 800€; das macht einen Gesamtbetrag von 900€ im Oktober und liegt damit unterhalb Ihres monatlichen Freibetrags, weshalb Sie keinen Importzoll zahlen müssen.
Beispiel 2: Am 5. Oktober haben Sie eine Lieferung im Wert von 100€ erhalten und am 20. Oktober eine im Wert von 910€; das macht einen Gesamtbetrag von 1010€ im Oktober. Jetzt müssen Sie 30% Steuern auf alles über 1000€ zahlen. In diesem Fall sind das 30% auf 10€.
Zur Registrierung und um eine reibungslose Abwicklung zu gewährleisten, müssen Sie eine Kopie ihres Passes einreichen. Es kann vorkommen, dass der Zoll Sie um zusätzliche Formulare bittet.
Bearbeitungsgebühr des Zolls:
Sie müssen keine Bearbeitungsgebühr an den Zoll zahlen, wenn Ihr Bestellwert weniger als 200€ beträgt. Ist der Wert Ihrer Bestellung höher als 200€ und niedriger als 1000€, müssen Sie eine Gebühr von 800 Rubel plus 144 Rubel Mehrwertsteuer pro Paket zahlen.
Wenn der Wert Ihrer Bestellung über 1000€ liegt, müssen Sie 2100 Rubel sowie 378 Rubel Mehrwertsteuer für Pakete mit einem Inhalt von bis zu fünf Artikeln zahlen. Ab dem sechsten Artikel müssen Sie für jeden von bis zu fünf zusätzlichen Artikeln 500 Rubel plus 90 Rubel Mehrwertsteuer zahlen.
Das Aufheben Ihres Pakets ist während der ersten drei Tage kostenlos. Ab dem vierten Tag müssen Sie pro Tag und Kilo 6 Rubel plus 1,08 Rubel Mehrwertsteuer zahlen. (Die minimale Gebühr beläuft sich auf 600 Rubel plus 108 Rubel Mehrwertsteuer.)

Bis zu dem Moment, wo Ihre Bestellung bearbeitet wird, können Sie diese jederzeit ohne Angabe von Gründen stornieren. Wird Ihre Bestellung bereits bearbeitet, können Sie diese nicht mehr stornieren, aber die Ware kann nach Erhalt zurückgegeben werden. WIE LAUTEN IHRE RÜCKSENDEBESTIMMUNGEN?

Um eine Retoure einzuleiten, gehen Sie auf “Meine Bestellungen & Retouren” in Ihrem OUVENIR-Konto gehen. Hier können Sie über den bereitgestellten Link das Versandlabel direkt über unser Retourenportal abrufen und ausdrucken.
Legen Sie den Artikel, den Sie zurückgeben möchten, in Ihr Paket zurück. Schließen Sie das Paket sorgfältig und bringen Sie den Rücksendeaufkleber an Ihrem Paket an. Geben Sie das Paket in einer DPD Filiale ab oder vereinbaren Sie einen Abholtermin mit UPS. Sobald das Paket bei unseren Partnern eingetroffen ist, erhalten Sie eine Bestätigung.
Alle bestätigten Rückgaben werden dem ursprünglichen Karten- bzw. Kontoinhaber unverzüglich in derselben Währung wie der Kauf erstattet.
Das Rückgaberecht gilt nur für ungetragene, ungewaschene und einwandfreie Artikel, von denen die Etiketten nicht entfernt wurden. Sollten Sie mehrere Artikel von unterschiedlichen Partner Stores zurückgeben wollen, müssen Sie die Rückgabe pro Partnerstore einzeln zurückschicken. Personalisierte Artikel sind vom Umtausch ausgeschlossen.

1.1. STYQUE GmbH (hereinafter “STYQUE”) operates a marketplace platform under the name OÙVENIR (hereinafter the “Platform”) which procures products (hereinafter “Products”) from stationary retailers (hereinafter a “Vendor”, or “Vendors”) to end customers (hereinafter a “Customer”, or “Customers”) under the domain, www.ouvenir.com, and, if applicable, various sub-domains.
1.2. The Platform is also offered to Customers through partners (hereinafter “Venues”) such as hotels. STYQUE will also be the operator of the Platform in those cases; the Venue will merely be a distribution channel.
1.3. The Vendor whose Products are procured through the Platform operates a stationary retail store with customer traffic and opening hours usual in the area (hereinafter “Store”).
1.4. The transactions are processed through the Platform exclusively subject to the following general terms and conditions of use for the Platform, as well as the Vendors’ general terms and conditions of sale, which are displayed through the Platform for each individual Product offered by the Vendor.
2.1. The operator of the Platform and the contracting party for the use of the Platform is STYQUE GmbH:

2.2. Only the Vendor which offers its Products for sale through the Platform of STYQUE is the contracting party of Customers for the purchase of Products.
3.1. Through its Platform, STYQUE procures sale and purchase agreements for Products between Vendors and Customers. In so doing, the Vendor may offer its Products to Customers through the Platform for the purpose of a binding order and purchase through the Platform or the non-binding reservation and a subsequent purchase in the Vendor’s Store.
3.2. Through the Platform, STYQUE will transmit binding orders of Customers for Products to the Vendor and, in turn, transmit the Vendor’s binding declaration of acceptance to the respective Customer (hereinafter “Orders”).
3.3. Through the Platform, STYQUE will also transmit non-binding reservation requests of Customers for Products to the Vendor and, in turn, transmit the Vendor’s confirmation of the reservation to the respective Customer (hereinafter “Reservations”).
3.4. STYQUE itself does not offer any Products and is no contracting party to the sale and purchase agreements entered into between Customers and Vendors. This also includes the offered shipment and payment services. In connection with the negotiation and conclusion of contracts between Customers and Vendors, STYQUE will not make any declarations of intent of its own.
3.5. STYQUE will provide the Vendor with all data which are required for the purchase settlement, payment and shipment of the Products to the Customer, or for the Reservation of the Products in the Store. To this end, the Customer will provide STYQUE with all necessary information and data through the Platform and authorize STYQUE to provide such information and data to the Vendor in compliance with data protection laws. STYQUE will not assume any liability for the accuracy and completeness of the information and data provided by the Customer.
3.6. The Customer’s personal information and data will be entered manually or may, in part, be entered through a social login. Optionally, the Customer’s information and data may, with the Customer’s consent, be stored on the Platform, so that they are not required to be collected once more for additional visits and purchases.
3.7. In relation to the Vendor, STYQUE will only ensure the statutory disclosure of the price information, shipping costs, legal notice, general terms and conditions of business, instructions on the right of revocation, and the note regarding the online dispute resolution on the basis of the relevant information provided by the Vendor. STYQUE will not assume any liability for the accuracy, completeness and lawfulness of the information, general terms and conditions of business and instructions on the right of revocation provided by the Vendor.
3.8. The articles sold by Vendors are exclusively intended for private use. Customers hereby agree not to use or resell any purchased Products for commercial purposes.
4.1. Subject to section 10.1 below, any Orders or Reservations by Customers will be displayed to the Vendor through the Platform in real time.
4.2. As the Products of Vendors offered on the Platform are also sold through the Vendors’ Store, the availability of a Product offered on the Platform by STYQUE cannot be guaranteed. The Vendor is obliged to review any incoming Orders or Reservations by Customers without undue delay during the opening hours of the Store and to accept or reject them depending on the availability.
4.3. Orders: Upon the acceptance of the Customer’s Order by the Vendor, a binding sale and purchase agreement between the Customer and the Vendor regarding the ordered Products will come into existence on the conditions stated to the Customer on the Platform and subject to the Vendor’s general terms and conditions of sale.
4.4. Reservations: NO sale and purchase agreement will come into existence upon the confirmation of a Reservation in relation to a Product by the Vendor. In such case, a sale and purchase agreement will not come into existence until the reserved Product is paid and collected by the Customer in the Store.
5.1. Products which are intended to be delivered to a stated delivery address (e.g., home address) within Germany or internationally will be collected from the Vendor by a parcel service and will be delivered to the Customer.
5.2. Products which are intended to be delivered to an address in the same town or region (e.g., hotel address) as the Vendor’s town or region may optionally be collected from the Vendor by a courier service and will be delivered to the Customer on the same day, provided that this can be done within the scope of a “same day delivery” service.
5.3. Deliveries to hotel addresses may only be effected if the hotel is listed by STYQUE in the selection field when entering the delivery address. In the event of a delivery to a hotel, the Customer must state his/her room number and confirm that the Customer has been registered as a guest in the respective hotel and is reachable at that room number at the time of delivery. If the Customer has not been registered in the hotel at the time of delivery, all costs incurred for the return of the Product will be charged to the Customer.
5.4. When shipping the ordered Product, the Vendor must enclose a proper invoice and a delivery note regarding the shipped Product.
6.1. After the acceptance of the Reservation, the Vendor will trigger the confirmation to the Customer that the Product will be deposited in the Store for collection within the reservation period stated in the shopping cart. Depending on the Vendor with which a Product has been reserved, the reservation period may vary as a result of different shop opening hours. The reserved Product will be prepared by the Vendor without undue delay for a collection by the Customer and will be ready for collection from the reservation time displayed in the shopping cart, and 30 minutes after the confirmed Reservation, at the earliest. In exceptional cases, for example, in relation to Vendors with irregular shop opening hours, only a collection different from the collection stated above, which will also be displayed in the shopping cart, will be possible.
6.2. STYQUE will provide the Customer with an order number or a collection password. These serve as an identification of the Product to be collected by the Customer, or another person named by the person as a collector, and show that the Customer, or the other collector, is authorized to collect.
6.3. Once the reserved Product has been collected by the Customer, or the collector authorized by the collection password, the Vendor will confirm the collection to STYQUE by entering the order number or the collection password in the STYQUE system. The Vendor is expressly prohibited from selling a Product reserved by the Customer to the Customer during the reservation period in another manner than the manner stated above.
6.4. The Product acquired and collected by the Customer will be settled up through the cash register system in the Vendor’s Store. The Vendor must issue to the Customer a proper invoice for the acquired and collected Product.
7.1. In the case of Orders of Products through the Platform, the statutory right of revocation of consumers in force from time to time will apply. That right of revocation of the Customer relates to the sale and purchase agreement entered into between the Customer and the Vendor. The right of revocation may be exercised through the Platform or in an alternative legally admissible manner. To this end, STYQUE will provide a form for Customers in its platform in order that the revocation can be processed as simply as possible. Any incoming revocations will promptly by forwarded by STYQUE to the Vendor, and the Vendor will be required to process them.
7.2. Any products in relation to which the right of revocation is exercised must be returned to the address of the respective Vendor stated in such Vendor’s instructions on the right of revocation. STYQUE hereby expressly points out that no return shipments will be accepted. The costs (if any) of the return shipments to the Customer, or the forwarding to the Vendor, will be charged to the Customer.
7.3. The money to be refunded will be refunded to the Customer by the Vendor’s payment services provider by the same means of payment by which the Customer had originally paid.
7.4. In the event of an effective revocation, the Vendor must also acknowledge to the Customer the return of a product.
7.5. If the Customer purchases a Product reserved for the Customer in the Store, consumers will NOT have a right of revocation in relation to that type of a sale and purchase agreement. Individual arrangements between the Customer and the Vendor, for example, as a gesture of good will, remain unaffected thereby.
8.1. In relation to Orders and return shipments through the Platform, payments will be settled through one or more payment services provider(s) offered by STYQUE (currently Stripe and PayPal). Those payment services providers offer to Customers common payment options within the Platform, collect the purchase price and the shipping costs from the Customer, transmit the purchase price and the shipping costs to the Vendor and STYQUE, and settle revocations. In the payment settlement through a payment services provider, such provider’s general terms and conditions of business in force from time to time will apply. The payment services provider will be instructed in the name, and for the account, of the Vendor. STYQUE merely intermediates that service. All rights and duties, as well as the liability in relation to, inter alia, the payment settlement, are governed exclusively by the agreement entered into between the Vendor and the payment services provider. A liability of STYQUE is excluded.
8.2. The available payment options for an Order will be displayed in the shopping cart. STYQUE, or the Vendor, reserves the right not to offer individual payment options and to refer to one or more payment option(s). In relation to conspicuous Customers, each payment option may be excluded for the purpose of fraud protection, so that the Customer will be unable to acquire the Product in the shopping cart.
8.3. If the payment option “credit card” is selected, the invoice amount will be due immediately upon the conclusion of the contract. The payment option “credit card” is currently settled in cooperation with Stripe Payments Europe, Ltd. (hereinafter “stripe”), to whom the Vendor assigns its claim for payment. In such case, payments with discharging effect may only be made to stripe. stripe will collect the invoice amount from the credit card account advised by the Customer. If the payment option “credit card” through stripe is selected, the Vendor will also remain competent for general customer inquiries such as in relation to the product, delivery time, shipments, return shipments, complaints, declarations of revocation or credit notes. The general terms and conditions of business of stripe in force from time to time can be called up at https://stripe.com/de/legal.
9.1. The prices stated at the time of the Order or the Reservation in the offer apply to Orders and Reservations for Products offered in the Platform. The stated prices are final prices, i.e., they include the statutory VAT in force from time to time and other price components, excluding shipping costs.
9.2. Standard shipping costs, which can be inspected at any time under the service-section, “shipping costs”, will be charged for each individual Order. Shipping costs may differ in the case of goods which must be shipped as “bulky goods” or by freight forwarders, as well as in the case of international shipping.
9.3. In the event of Products ordered from different Vendors, the shipping costs are stated per individual Vendor.
9.4. No shipping costs are charged for Reservations.
9.5. The Customer bears the costs of return shipments.
10.1. Basically, STYQUE will keep the Platform available 24/7. STYQUE hereby expressly reserves the right to carry out maintenance services in relation to the Platform between 0:00 a.m. and 8:00 a.m. daily with prior notification in order to ensure the proper provision of the services. STYQUE does not guarantee to Customers the technical availability of its Platform.
10.2. STYQUE will not be liable for disruptions of any type whatsoever which are caused by circumstances outside STYQUE’s control. This applies, in particular, to the breakdown or disruption of telecommunications lines, power failures or any impairments and malfunctions caused by the improper use of the software and hardware by the Customer or third parties, as well as an unlawful attack on the Platform or a service provider intermediated by STYQUE.
10.3. STYQUE will not be liable for any loss of profit or other damage incurred, unless the damage was caused by STYQUE as a result of intent or gross negligence. STYQUE’s liability for slight negligence on STYQUE’s part is limited to the typical and foreseeable damage.
10.4. The Customer will be liable for any activities performed while using its user account, unless the Customer is not responsible for a misuse of its user account, as the Customer did not violate its duties of care.
10.5. As STYQUE is not involved in the contractual relationship between the Customer and the Vendor, STYQUE will not assume any warranty and/or liability for services under the sale and purchase agreement for the Product.
10.6. In its Platform, STYQUE refers to links to other websites on the Internet. The following applies to all such links: STYQUE expressly declares that STYQUE has no influence on the design and contents of the linked sites. STYQUE hereby expressly dissociates itself from all contents of all third-party sites linked in its Platform and does not appropriate any such contents. That declaration applies to all displayed links and all contents of the sites to which the links lead.
All image rights are held by STYQUE or the Vendors. Any use without an express consent is prohibited.
12.1. German law applies exclusively, to the exclusion of the UN Sales Convention (CISG) and private international law.
12.3. The European Commission has established a platform for online dispute resolution, which can be called up at http://ec.europa.eu/consumers/odr/.
